* Practical discipline: the balance between meeting legal requirements and saving management time / avoiding disputes. How to settle disputes fully and finally, avoiding costly (and risky!) legal procedures.
* Disciplinary hearings : practical guidelines and latest tips for management: when are hearings not required; the role of different participants in the hearing. How to prepare,questioning, cross questioning and the sequence of events at the hearing; how to prove a balance of probabilities; Practical hearing checklists; the actual conducting of an ideal hearing focusing on doing what is right and fair without wasting management time.
*Formal v Informal discipline : how to save time without making costly mistakes.
*The effect of disciplinary warnings in practice, validity periods and assessing severity.
*The importance of flexibility: procedural and substantive fairness.
* What does “inconsistency” mean in labour law and how to approach this.
* How to use suspension correctly.
*Trouble shooting : desertion, demotion, suspension, fixed term contracts, constructive dismissal, misuse of sick notes, the validity of traditional healers certificates, incapacity, incompetence, incompatibility, poor performance, intoxication, dishonesty, gross negligence, polygraphs, sexual-harassment etc.
*The impact of Covid-19 on Labour Law.
*Union interaction : management tips.
*Strike handling – the latest tactics to protect management.
(With a video presentation of dealing with an actual strike in practice)
*Recent changes to labour legislation and the effect of this from a management perspective; the use of temporary (fixed term) contracts and labour brokers and the impact of the latest Constitutional Court case law in this regard
* Management friendly employment contracts.
*The consequences of incorrect action: how to avoid getting into time- and money consuming dispute mechanisms of Bargaining Councils/CCMA/Labour Court.
NOTE : This is a fast moving, practical and compact presentation!
The presentation will be in English and Afrikaans.
A well structured, comprehensive work book for future reference, draft “employer friendly” employment contracts, both permanent- and fixed term, incorporating the latest legal requirements, are included. Electronic presentations of a simulated actual ideal disciplinary hearing and the legally correct handling by management of an actual strike shall also be presented.
TARGET LEVEL

Dr.Lukas Du Preez is a well-known Advocate and management consultant with more than 40 years experience in labour law, consulting exclusively for management across industry throughout South Africa. He acted- and consulted for various large national and multi-national Companies eg. Sasol, Gold Fields, Hyatt Hotel Group, Hilti SA, Aspen, Samrec, Protea Coin Group, Fidelity, Agri SA, the Wine Industry and many local employers in the Southern Cape in recent years. He was also previously Labour Advisor of the AHI and advisor to various labour law investigative committees/bodies over the years. Lukas holds a doctorate in labour law.
